AC21 is the only light at the end of the tunnel for doing such things. If you change employer before I-485 is filed and pending 180 days, all you will get will be your labor priority date. You will have to file labor and I-140 again with your new employer and when filing I-485 you can use your old priority date.

When Senate Majority Leader Harry Reid picked up his ball and went home after his staged all-night session last week, he saved from possible embarrassment one of the least regular members of his Democratic caucus: Sen. Ben Nelson of Nebraska. Reform Republican Tom Coburn had ready an amendment to the defense authorization bill removing Nelson's earmark funding a Nebraska-based company whose officials include Nelson's son. Such an effort became impossible when Reid pulled the bill.
That Reid's action had this effect was mere coincidence. He knew that Sen. Carl Levin's amendment to the defense bill mandating a troop withdrawal from Iraq would fall short of the 60 votes needed to cut off debate, and Reid planned from the start to pull the bill after the all-night session, designed to satisfy antiwar zealots, was completed. But Reid is also working behind the scenes with House Speaker Nancy Pelosi to undermine earmark transparency and prevent open debate on spending proposals such as Nelson's.
These antics fit the continuing decline of the Senate, including an unwritten rules change requiring 60 votes to pass any meaningful bill. When I arrived on Capitol Hill 50 years ago, Majority Leader Lyndon Johnson (like Reid today) had a slim Democratic majority and faced a Republican president, but he was not burdened with the 60-vote rule. While Johnson did use chicanery, Reid resorts to brute force that shatters the Senate's facade of civilized discourse. Reid is plotting to strip anti-earmark transparency from the final version of ethics legislation passed by the Senate and House, with tacit support from Republican senators and the GOP leadership.
At stake is the fate of Coburn's "Reid amendment," previously passed by the Senate and so called because it would bar earmarks benefiting a senator's family members such as Reid's four lobbyist sons and son-in-law. Nelson's current $7.5 million earmark for software helps 21st Century Systems Inc. (21CSI), which employs the senator's son, Patrick Nelson, as its marketing director. The company gets 80 percent of its funds from federal grants, mostly through earmarks. With nine offices scattered among states represented by appropriators in Congress, the company has in recent years spent $1.1 million to lobby Congress and $160,000 in congressional campaign contributions. "As of April," the Omaha World-Herald reported, "only one piece of [the company's] software has been used -- to help guard a single Marine camp in Iraq -- and it was no longer in use."
In requesting the 21CSI earmark, Nelson did not disclose his son's employment. "There's no requirement that he disclose that," a Nelson spokesman told this column. "But frankly, in this case, we didn't disclose it because it's so public." An April 24 letter from Levin giving senators instructions on how to request an earmark made no mention of the "Reid amendment" that had been passed by the Senate three months earlier but that required only certification that no senator's spouse would benefit from an earmark. Inclusion of Nelson's son, however, would be required if the ethics bill provision passes.

Last night's performance made us the laughingstock of the world." It may get worse if plans to eviscerate ethics legislation are pursued.

I was also in the same boat couple of months back and got two appointments. Technically we can send a letter to USCIS with explanation. But my attorney suggested me to go for the second appointment. So I went twice..

New filing fees were applicable from 7/30. Do all applications(485/131/765) whose PD is current need to filed with the new fees starting from 7/30? Or till 8/17 it can be filed with the old fees?

I gave first FP on 9/28 and lat month I took info pass and the officer raised a SR for non delivery of cards to which I got a reply that my card might have lost in mail. I called USCIS who mentioned that my card was never created and now it will be created. Now my online status changes mentioning that I have been sent FP notice again. I called uscis again and mentioned that I already gave biometrics
The officer said it was erroneous so ignore the FP notice and he will be requesting CPO for me. I even called FBI FP line today to confirm that my first FP was fine and they said it was fine and uploaded

Hi,
My Spouse Application was rejected due to incorrect fee though the USCIS were accepting application with old fee till august 17th! It was filed on August3rd! and it was with old fee! Will it be accepted if we send a letter that the fee was right the first time!
Has anybody's both primary and spouse applications got the receipts with old FEES and had applied in AUGUST, Pls reply asap as my spouse application rejected and we had applied on august 3rd!

I have a offer from an employer and they say that they will be able to provide documentation for GC processing but will not be able to sponsor. What does that mean? Can i hire attorney for my GC processing(EB2) and pay the expenses by myself? What else would be required from the employer?

I am in 7th year of H1b. I joined comany A in May-2003 and filed EB3 base in Nov-2003. I had approve labor and I-140.
I moved a big company (Company B) in 06/08/2007 (just few days before the EB categories got current).
Company A has agreed to help me file I-485
Company B is ready to file new PERM (Earlier it was agreed that after PERM approval PD will be transferred).
What would be the best bet now?
Is it OK to file I-485 myself with approved I-140 from comany A (With intention to join them later)to be safe and
File new PERM with Company B..later (after PERM approval) transfer PD from my old case and file I-485 again (It would take approx 6 months min).
Any comments / suggestion will be greatly appreciated.

Hey,
I have a 290B pending at Texas which was submitted on 20 Nov 2007. I had a LUD on 27 Nov. Nothing happened after. Based on others experience (in NSC) it is taking about 4 months for something to happen. No clue about TSC. Just sit tight and have a backup plan. Good luck.

I am on H1. I got married earlier this year :), my wife is on OPT which expires early next year. She is currently working for XYZ company which would not extend her OPT. We haven't been able to find a job(H1) for her yet.
Would any of below can cause any problem.
1. I don't have H1 stamping from my home country??
2. Her last name is not changed??

As far as I know you do not need to get a new visa stamping. At least, it was like that when I was on F-1. What you need to re-enter is to have I-20 from new school. Check with the school's international students adviser.

I am going to apply for Eb2. I already have Eb3 approved with the company that I am currently working. The other brand new company is offering me Eb2 with Perm but they don�t have any master degree in the company and also they have a very dummy attorney. I am not joining them until I can file 485 and make sure that I would not lose my PD.
I am form rest of the word category and the Eb2 in current.
Can some one help me with the ad text for Industrial engineer with +6 years of experience. The attorney doesn�t have any clue about Eb2 and specific add in paper. I guess I am going to help her.

My husband was an employee of a desi company and they had withheld part of his salary, he filed a complaint at the DOL and got the pending money back.. that was 4 years back.. now he is trying to change his job and the new employer wants to do his background check..
what will show up in his background check? will the case against his employer affect him? we are really worried about this.
