An old, old friend who is a major voice in conservative politics in this country agreed with this when we spoke about the election today (he was obviously a lot happier today than me). Goal = 5000 votes on survey (see I-485 filing w/o current PD thread) and momentum to continue with this campaign.The survey is a platform to gather and push for launching action items. Based on response by 04/30/2011 - IV will decide whether to even proceed with initiative or not.

As suggested by pappu/starsun, this supporting thread provides impacted members with additional information and tools to help the initiative.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

Hi,
Currently I am on H1B visa.I will file my 485 as secondary applicant.What are my options in case If I have to leave my job and my 485 is still not approved.
Do I need to file H4 (Since 485 is still not approved) ?

You can status will be Adjustment of Status ( AOS ) but cant work . IYou need a APO if you want to travel . If you want to work you need an EAD .

Folks,
Here's one question I have which I haven't see in any forums so far (perhaps its lurking somewhere .. who knows) ... let me get to the point.
When filing for AOS/485, if the I-140 that was filed prior to filing AOS was pending and gets approved AFTER 485 was filed... should we explicitly inform USCIS that that 140 was appoved ?
I guess USCIS should have that information (of course!) but I am not sure if we should be pro-active and make sure we inform the service center that the 140 was approved ?!

For me it took 1.5 months. I visited the consulate to check the status. Typically you can check the status of your passport renewal from CGI mail room. They can tell you whether your passport is processed, mailed etc.
Unfortunately CGI Houston has very poor customer service. They won't answer your calls or reply to your emails.

I see lot of excitement about asking USCIS about filing for I-485
even when visa numbers are unavailable. I am afraid this may
not work.
The ombudsman report 2005 was very critical about temporary EADs being issued to "potential terrorists" without proper background check. Filing for I-485 and getting EAD is like a limbo state btween GC and H1B. This approach may not gain much support.
(1) How about proposing that they should do FBI name check with I-140?
This is the petition for immigrant visa.
(2) Those who have approved I-140 but haven't filed for I485 due to
retrogression can apply for FBI name check separately.
(3) These added "security measures" will boost our chances of getting them OK to file for I-485 even when PD is not current.
p.s
the argument that FBI name check is valid only for a breif period is stupid, but it may be forthcoming. The response is what if some one commits terrorism 6 months after getting GC:D

I have heard in the past from a lawyer that when in H1B status the filing of Green Card must be done and labor certification approved before the 5th anniversary of H1B status. In other words, one cannot start the process for a Green Card in the 6th year of H1B status.
Is this correct? Or is the lawyer being overly cautious?
If such a rule does exist can you please point me to the exact regulation?

This is the latest update as of Tuesday, April 6, 2010, Vermont Service Center, as of close of business on Monday, April 5, 2010, VSC had received a total of 9,525 cap-subject H-1B petitions. Of those petitions, 6,791 were "regular" cap, and 2,734 were advanced degree. All cases received before April 7, 2010, will have an April 7, 2010 receipt date. Those received on April 7, 2010 or later will bear the actual receipt date. For those submitted for Premium Processing, the clock will start on April 7, 2010. We will update once we have the California Service Center Numbers.

My I140 (Bachelor degree, EB3, PD: Nov'04) was approved last month from my previous employer.
I completed my MBA in Jun'06 and joined another company; my job description has changed totally and I can't use previously approved labor for my new job. My new employer will initiate the process of labor, next week.
I checked with my previous employer and he informed me that he is ready to give me a support letter, if I want to go ahead and file I485 based on EB3 I140.
Questions:
Is it possible to file I485, even if we are not working with the employer?
Once I have filed I485 based on my EB3 I140, and if the application remains pending for next 6 months, is it still possible to port the PD (Nov'04) to the new EB2 based petition?

This might be little bit old, but I dont remember seeing a post on this. Employment-based immigrant visa fees almost doubled, Old fees $ 355, new fees $ 720 from July 13th. Does this mean USCIS will open the gates in Sept bulletin [to be released in August]?
