    IF I COMPLETE MY M.S. IN 1 YEAR AT A U.S. UNIVERSITY
    AND THEN IF FILE A H-1B THROUGH A CONSULTANCY

    WILL COMPLETION OF MY M.S. IN 1 YEAR BECOME A PROBLEM FOR GETTING A H-1B IN THE MASTERS (M.S.) QUOTA OF 20,000?

    BCOZ SOME OF MY FRIENDS TOLD ME THAT IT IS NOT GUD TO COMPLETE M.S. WITHIN 1 YEAR OR IN EXACTLY 1 YEAR, LATER IT BECOMES A PROBLEM FOR GETTING A H-1B THROUGH M.S. QUOTA.( THEY SAID THEN I WILL HAVE TO GO THROUGH GENERAL 65,000 QUOTA AND WILL NOT BE ELIGIBLE FOR 20,000 M.S. QUOTA, if m.s. is completed in 1 year)

    IS IT TRUE, IS THERE ANY SUCH IMIGRATION RULE DURING H-1B FILING

    Hello All,

    I will be appearing for L1 individual visa extension in chennai in a few days from now.

    One the questions that would be asked by the VO would be "where and who do you work for". The second part is easy since i work for the petitioning employer rendering my services for their client. However for the first part of the question what appropriate answer can be given?

    Can i mention the client name location in US since that is where i currently work although i am controlled by the petitioning employer. I would not be working from the petitioning employer work location in US. I believe the L1 Visa reform act of June 2005, tells that you can work from offsite location provided you are controlled/managed by petitioner.

    Please advise as it would help me in responding with correct answer. Thanks.

    is this true. My mother came back last year using AP but she never got a new I-94. He AP was stamped and the validity of her stay here. So not sure if you will get a I94 or not. please eloborate.

    My application was filed in EB3 category and PD is current (has been since start of this year). I have an approved I-140 since Feb 07 and the I-485 was filed prior to the mess of 2007. I have taken 4 Infopass appointments trying to find out why is it taking this long to get "a decision". At this point, I don't care what the decision is, as long as there is one so that I can move on in my life. Called and spoke with the processing center that the case is outside their "normal processing time" only to hear, "We are processing". They won't tell me what is going on.

    Wondering about my options here? Congressional inquiry? Writ of Mandamus? Anything? Anyone in the same position as me?

    Hello!

    I was laid off from Company A on H-1B in May 09. My EB2, India, I-140 was approved in Mar 09. Since PD is not current, I-485 has not been filed yet. Here are my questions:

    Can I retain my PD if Company A withdraws(worst case) my I-140 petition?
    If I find employment with Company B, can I still file my I-485 using Company A's I-140 petition assuming Company A provides me with an Employment Letter for future employment?
    If previous step is feasible and I-485 is approved within 180days of filing, will it pose any issues if I have to invoke AC21? (since I will be working for Company B when I file I-485 with Company A) I ask this because I have 2 yrs and 4months on my H-1B off the 6yr limit and I am afraid I might run out of H-1B time before I file I-485.

    You cannot file 485. You will have to start the process from scratch. However, you can use the priority date from the approved 140.

    Six years of Republican control in Washington have taken a toll on the country -- and the GOP is paying the price politically. Instead of the Bush administration ushering in a new era of GOP dominance, as Karl Rove hoped, it has set the stage for a Democratic resurgence.

    That turnabout was implicit in the results of the 2006 midterm election, when Democrats took back narrow majorities in the House and Senate and captured the majority of governorships. And it is reinforced by a massive poll released last week by Andrew Kohut and the Pew Research Center for the People and the Press.

    The survey of 2,007 people, conducted in December and January, depicts a dramatic shift in Americans' attitudes, opinions and values between 1994, when Republicans took control of Congress, and now. Most of the change has occurred since George Bush took office in 2001.

    The poll, which can be found at http://www.people-press.org, is a treasure trove of information about Americans' views of the parties, government, the world scene, religion, the economy, business, labor and a dozen other topics.

    But a word of caution is in order. There is little here that suggests voters' opinion of Democrats is much higher than it was when they lost Congress in 1994. It seems doubtful that Democrats can help themselves a great deal just by tearing down an already discredited Republican administration with more investigations such as the current attack on the Justice Department and White House over the firings of eight U.S. attorneys.

    At some point, Democrats have to give people something to vote for. People already know what they're against -- the Republicans.

    For those of you who either are residents (Citizens or PRs) or Canada or have been thinking about becoming residents of Canada but working in US, please share your experience in terms of:

    1. How you maintain your residency (or non-residency) in both countries.
    2. What are the tax implications if you maintain residency in both countries,
    specially if you own property in Canada.

    I have heard stories about tax implications in Canada if you own property there even if you permanently live an work in the US. Is that true? Would you be considered a resident in Canada for tax purposes just because you own property (such as vacation homes) but live permanently in US.

    I currently own a property in Canada but have been living and working in US for past 8 years and really worried about any tax implications in Canada because of the property. Any help would be very much appreciated.

    If one has Green Card based on family preference (son of US citizen), how long he has to stay in USA to maintain his Green Card. I heard it is min 180 days in a year ? Is that correct ?

    What are other restrictions ? Does it impact citizeship ?

    A detailed answer would be very helpful.

    Also If one has Green Card which one if faster router to get his spouse to USA:
    1. Applying as daughter in law of US Citizens. Or
    (what family preference catergory this is ?)
    2. Applying as wife of person having Green Card

    Hello Everybody. I am new to IV. Recently I have filed my wife's I-485 (06/28) after my I-485 approval on 06/18. My lawyer said that he has filed it by using the "Follow to join" benefits. He is saying that he cannot guarantee that USCIS will accept the I-485 since my I-485 is already approved. He said that we just have to wait and see until the receipt notice is issued.

    Is anybody else in similar situation? Also does any one know what kind of documentation and cover letter needs to be included for this kind of case? I have asked him if he has included the I-485 approval notice and he said "No".
