I graduated in Dec 2008 from USA and then returned back India. My F1 visa is valid till dec 2011 and am planning to come back USA for pursuing my phd. I got I20 from a different university. Do I need to attend for f1 visa stamping again ? . Please help .

As many readers may know for I-129 that is used for H, L and O Petition has been revised. On December 20, 2010, USCIS informed stakeholders that it will accept previous editions of Form I-129 that are postmarked on or before December 22, 2010. Petitions postmarked on or after December 23, 2010, must include the new Form-129 with a November 23, 2010, revision date or else they will be rejected. This contradicts earlier guidance stating that the last day USCIS could accept previous editions of the form was December 22, 2010.
We hope that this update clarifies some of the confusion regarding the last date the old form can still be used.

This is the latest update as of Tuesday, April 6, 2010, Vermont Service Center, as of close of business on Monday, April 5, 2010, VSC had received a total of 9,525 cap-subject H-1B petitions. Of those petitions, 6,791 were "regular" cap, and 2,734 were advanced degree. All cases received before April 7, 2010, will have an April 7, 2010 receipt date. Those received on April 7, 2010 or later will bear the actual receipt date. For those submitted for Premium Processing, the clock will start on April 7, 2010. We will update once we have the California Service Center Numbers.

Hi,
I have already filed my I-485 in Aug 2007. My employer is moving to a new office space in the same city. It is almost 2 miles from where I'm working now. Do I need to notify USCIS of this change? If so, how would I do it? Could anyone please suggest.

There has been a lot of confusion today about the so called "Frist new bill" -- it is just the Hagel-Martinez bill which was brought for a cloture vote before the Senate Easter recess. I have edited to title of the thread with the text of the bill to reflect this.

Hi
I have a question regarding my spouse who is on H4 visa.she has real experience in India for 5 years. One of the company who does some projects did H1b processing through "CONSULAR PROCESSING". Her H1B is approved now.
1) Employer is saying she has to go out of the country to get the visa in order to work.
2) Apply for change of Status while staying in USA. Employer saying that there are chances of getting an RFE during that process. Is there any Premium process in Change of Status processing.
which one is advisable?
Can any one please suggest.

One of the stand out football players for the United States Military Academy at West Point is junior Alejandro Villanueva, a Spaniard who played high school football in Belgium. The wide receiver is also the tallest player in all of college football - 6 foot, 10 inches. Villanueva will have to serve five years in the Army after graduating and will probably be deployed to Afghanistan or Iraq. I am a July 2007 filer. I filed for I-485 using the old fee structure and also applied for AP in July 2007. My AP got approved in 07 but expired so I had to apply for AP in Aug 2008. So I filed in Aug 2008 and paid $305 for AP fee. Now it's to reapply for AP as it expires soon; however I was under the impression that I wouldn't have to pay for AP fee again. I sent the forms to USCIS but the AP package got returned as they claim i don't qualify for free fling.
Anyone else in this position (I am assuming a lot of you guys are... please share your experience). Do we have to pay every year for AP?
