    My attorneys screwed up and filed my I140 under the wrong category. (EB3 instead of EB2). They refiled PP but without the original Labor cert attached. My PP application is not approved yet.

    I called a couple of weeks ago and they told me they wont do PP because the original labor cert was not attached.

    I Emailed them yesterday and this is their reply:

    'This petition has been assigned to an officer,but no decision has been made.'

    Does this mean anything? meaning is it close to being approved??

    What is the point of publishing dates for people to see if they have no relevance?
    If they are just for CIS employees to see... why publish them publicly and confuse the deuce out of the entire immigrant community?

    If they are "a statement of goals", why aren't these goals being adhered to?

    Why set and publish goals that are are not followed?

    One of the RFE we got has the following two questions.

    1. IRS Tax Return Filing Status: Submit an original computer printout from the Internal Revenue Service (IRS), date stamped by the IRS, showing the status of all tax returns filed by the U.S. company.

    2. IRS Computer Tax Records: Submit original computer printouts from the Internal Revenue Service (IRS), date stamped by the IRS, of tax returns filed with the IRS by the U.S. company for the years: 2007-2008

    How to get these documents from IRS website?
    Time left is very short, pls help !

    Folks,

    We received letter from USCIS NSC saying that our AP (incl. my spouse) were approved on 10/15/08. On 11/17/08 we received RFE on my spouse AP application for photos. My wife had already left for India (11/15/08) assuming that our AP was approved. Anyways.

    My question - If NSC approves her AP application (again), which date will she have on her approved AP application (i.e will the date be still 10/15/08 OR after the RFE response for photos). Photos were received at the NSC on 11/26/08.

    Is anyone in the same situation. Your input is much appreciated.

    My current AP expires on July 30, 2008. I am planning to apply for renewal in Jan or Feb 2008, which is 6 months prior to expiration. I understand that nowadays it takes more than 3 months for approval.

    In case of emergency, Can I travel to India with my current AP while AP renewal petition is pending?.

    Thanks for your help.

    I do not foresee any problem in using your current AP, if your travel time is well within it's period.

    Hi, Im a pediatritian from Venezuela. I was hired by a research institution to work for a year here in the US, and i was granted a H1b non clinical Visa about 3 months ago. A month ago I was offered a position on the fellowship program of Pediatric Critical Care at the same institution but they need to change my visa to a Clinical H1b visa. I went to all the process here in the US. I havent go to Venezuela to get my passport stamped but at the International Depatment of the Institution they told me that i can Travel to Mexico or Canada for less than 30 days without my passport stamped, no problem. I have plans to go to Mexico for Christmas. Now my question is:
    Can I travel to Mexico with my first H1b visa aprooval while my other H1b visa is on process?

    As of April 15, 2010, approximately 13,600 H-1B cap (http://www.h1b.biz/lawyer-attorney-1137085.html)-subject petitions had been filed. USCIS has approved 5,800 H-1B petitions for aliens with advanced degrees.

    Many immigration lawyers are seeing a sharp decline in the interest in the H1B visa this year by potential employers and workers. Some are saying that the downturn in H1B applications this year could be as much as 60%. As a result of this decline, there are predictions that the quota will not be reached within the first few months of this year. Rather, many suspect that the bachelor's quota won't be reached until the middle of July, and that the master's quota won't be reached until later this June.

    We shall see how the number will play out in the next few months.

    Hi all,
    I am an American and my wife is going though the green card application process. We recently received our interview date. Unfortunately, it was scheduled one day prior to our wedding ceremony which is out of the country. Our wedding is being presided over by the mayor of a fairly large city, with like 300 or so guests and at this point would be impossible to change. At the same time I hear that mixing international travel and rescheduling green card interviews is a risky thing.

    We have an infopass scheduled in two weeks, and beyond the supporting documents of our flight and wedding information, is there anything else we should bring to prove that we can't possibly be at this interview? Is this something a lawyer might be able to handle better (like have more credibility)?

    Anyone willing to give odds on us successfully changing our interview date?

    I am a july 2nd filer , still waiting for EAD for my spouse .I have got mine a week ago,but her case status has no change. When we call 1-800-375-5283 it says there is no information for this case, however we are able to check the case status online, which says received on October 15, and its still pending.

    Another issue is they did not honor the received date.

    Is there any one in similar situation?

    What can we do at this point? Will Infopass appointment or contacting ombudsman help?

    My wife is currently on H4 and we have EAD/AP, though not used. She is planning to apply for H1 with new employer.

    When approved, does she need to leave the country and get visa stamped before starting employment.

    If she leaves the country and enters using the AP document, will it cause any issues with her H1. Any input will be appreciated. Thank you.

    Here is a scenario:

    Previous I 140 (EB2 PD Sept 2005) approved and is now current

    Current I 485 filed based on another I 140 with PD in Dec 2006.

    Can port over to the previous I 140 and can make I 485 current. The issue here is still unmarried so would like to hold on for few months to port over the PD.


    Do you see an issue if porting is not done from EB2 Dec 2006 to the PD in EB2 Sept 2005?

    How does it work if married after 3-6months and then want to port the PD for the spouse as well? Does Previous I 140 PD current still hold good?

    If retrogression occurs once again do u still need to wait to port and get Green Card

    Do we (parent) gets any benefits in terms of Visa status if you have child born in USA and you stay in US for certain years?

    In the other word:
    Once you have child born in USA is there any way to get green card based on your child citizenship?

    Once the US citizen child is an adult (I think 21 years old), then s/he can sponsor the parents for green card.

    Otherwise, no.

    Yes in Montreal, Canada on Aug 26th, 2009. All is well. I got my h1b visa renewed for 3 years. They had to do electronic followup since my LIN is not found in PIMS. But I got my passport, visa next day at 3pm.

    On the EAD application form, Q15 asks for the current Immigration Status.

    What will be the immigration status of a person who entered US on H4 visa but started working later using EAD?

    Since I-94 has H4, Is it OK to mention the immigration status as H4/AOS Pending ?

    Guys,
    I think many of us would be in this situation. I am using my EAD for work and last year used AP to enter US. Parole Officer Stamped one year of validity date on my I-94 that is paroled until March 2009. Now I have new EAD which is valid for two years 2010 and New AP Dec' 2009 for one year of travel. My understanding was your date on I-94 indicates your legal status. So what would happen to my status once i stay after March 2009? I am planning to travel to India in June 2009.

    As Senate Democrats were preparing to go to the mattresses over Iraq voting procedures and as Republicans threatened to stop all activity over a judicial appointment, it's worth recalling what Senate leaders were promising at the outset of the 110th Congress.

    On Jan. 4, incoming Senate Majority Leader Harry Reid (D-Nev.) declared on the floor that "last November, the voters sent us a message - Democrats and Republicans. The voters are upset with Congress and the partisan gridlock. The voters want a government that focuses on their needs. The voters want change. Together, we must deliver that change."

    Minutes later, Minority Leader Mitch McConnell (R-Ky.) observed that "the challenges ahead will not be met if we do nothing to overcome the partisanship that has come to characterize this body over the past several years. A culture of partisanship over principle represents a grave threat to the Senate's best tradition as a place of constructive cooperation. It undermines the spirit and the purpose of this institution. And we must do something to reverse its course."

    Six months on, the Senate has devolved into a nonstop brawl. The House, where leaders made let's-work-together promises of their own, also is a cauldron of partisanship, but at least there the rules permit a majority to rule.

    But together, they've been able to pass just three pieces of significant legislation - a hike in the minimum wage, expansion of stem-cell research funding and a supplemental appropriation to fund the Iraq War. Only the first was directly signed into law. The second was vetoed by President Bush. The third was vetoed then passed.

    Partisan warfare and inaction on issues from health care to immigration to energy - even lobbying and ethics reform, once the top priority for this Congress - has reduced respect for the legislative branch to its lowest level ever. Respect for the presidency is not much higher.

    Who's to blame? Senate Democrats accuse Senate Republicans of "obstructionism" - systematic refusal to grant unanimous consent so that bills can be voted upon. Senate Republicans blame Reid for invoking cloture to stifle full debate and the offering of amendments.

    The level of rancor is escalating now because Democrats are frustrated that Republicans are insisting on a 60-vote threshold on Iraq War amendments - as though Democrats in the past have not used the 60-vote requirement when it suited them. Republicans are threatening to create procedural chaos and allow little or no action on the floor if Democrats block a single appellate court nominee.

    In January, Senators of both parties gathered in the Old Senate Chamber in what McConnell described as "a small act of bipartisanship" that he hoped would lead to a restoration of the Senate's reputation. Now, perhaps, Senators should regather there and contemplate their current level of public esteem.
