Hi, me and my wife we both r on H1b. My wife works with a solution & service LLC.say company A, now the owner is ready to start a new company, say B,with my wife as partner. She will be just passive investor in the company and getting profits, if any from company B. Can she still work full time with company A?. How can we invest in company B and take profits. is there any problem is getting profits more then 500K in a year.
What r IRS forms?. Finally any good attorney suggestions for Houston, TX.
What are the options for business formation,
Does anyone see any issue with this kind of formation and GC process for me..

Hi Gurus,
Request your help on my query. I am on H1B with an I 797 valid upto 29-Jan-2011 and dependants have stamped H4 visas valid upto 29-Jan-2011. My company is in the process of applying for my H1B extension (this will be my second extension and i have currently completed 4 yrs 9 months in US).
My dependants are planning to travel to India at the end of this month and plan to return back by end of Nov. Will they face any issues during their return at POE ?
Will there be any complications with our visa extensions ?
Appreciate your response at the earliest.

Here is the BEC update. GUYS, Any thoughts on the claim that RIR cases wil be complete by end of April 2007 ?
AILA's 03/15/2007 Liaison Meeting minutes reflect the following statistics:
Total Cases Pending: 96,304
TR Cases: Approx. 75,000 [Recruitment instructions and job order will be completed by Mary 2007]
RIR Cases: Approx. 20,000 [Most of RIR cases expected to be completed by the end of April, 2007, except problem cases]
Total RIR Conversion Received: 6,000
RIR Eligible Determination Cases: 5,100

This is my situation:
I am in my 8th year of H1B extension (2 one year extensions after 6 years)
I had my LC I140 approved, but due to retrogression I cannot continue with the adjustment of status.
This is my question:
If I move to a new position that would require me to file new LC (PERM), am I still subjected to the 365 days rule?
I am confused because my employer filed the LC 365 days prior to my H1B expire on the 6th year in order to get the extension. Now, since I can only have one year extension and I have less than 1 year left on my H1B visa, can the new LC still be filed? Will this jeopardize future H1B extension?
Am I missing something here? Is there another strategy?
Based on other discussion, it seemed that I am eligible for 3 years extension. But there are still 200 days left on my H1B visa. I suppose 3 years extension cannot be filed until near expiration date.

Just Ask her to redo the I-9 Employment Verification form and submit to the Employer. Nothing else needed.

You can file for FOIA to get it from USCIS if attorney is not cooperative. When was the labor filed? How much time it took to get approved.Just to get an idea on the timelines USCIS working on labor these days

Hi all,
My I-140 was approved 2.5 years back and I-485 was also approved more than an year back.
But, today the status on my I-140 got changed to "REQUEST FOR INITIAL EVIDENCE SENT, CASE PLACED ON HOLD". I am not sure, why did they reopen the case again. I checked with my company and they assured me that they didn't revoke my I-140.
Could anyone suggest me what's happening to my case. Has anyone seen an similar kind of an issue and wat shd I do further ?

I have quick question, coming month (April) I am going to Indian and planning for stamping. I have advance parole with me. If my visa got rejected or delayed can I come back to USA using my advance parole?
