No. You can file two I-140 petitions from the same employer and your approved H-1B for three years is not in trouble. I don't blame you for your deepest concern in this issue, as USCIS made each and everyone of us so concerned about our every walk of our life.

Could anyone throw some light on this...
i now finished school and I have a course completion letter from the school but I ma formally taking the walk in May.So i don't have an official degree yet.
I have to apply for a H1B visa Could I apply for a H1B on a masters quota with the course completion letter .I have heard yes but I needed confirmation with respect to this.
And If I don't get a H1B visa will my application slide to the Bachelors quota automatically(does this depend on the course completion letter that I have submitted?)??
My other doubt being since my company is not e verified what are my other options if I dont get a H1B visa???
Could you please throw light on all these matters?? I would be obliged if i can understand the answers to all these queries.

Could someone tell me please.....I'm filling the application for advance parole the first time......what should I write where it is written: " Date of intended departure"...if I dont know exactly when I'm leaving....should I write a date or should I write " I dont know yet?"
And also I read that the documents required are 2 photos, I-485 receipt notice, I-140 approval notice.....is that right? or what other documents do I need?
I would highly appreciate your help!

When you are working as fulltime employee for american client (not consultancy) then why are you worried?

I am a I-485 EB waiter and applied before August 18th. So I have to pay a fee fo 305 dollars. However when I went to check the I-131 instructions for e-filing, i could not find any information if we are eligible to e-file?
has anybody e-filed Advance parole.

I believe they promise a 15-day (business days, I assume) turnaround on Premium Proc applications. So it could take anywhere between 1 and 15 days, if not longer in certain cases.
Also, why is going to India dependent on receiving on an approval of I-140??

Hi,
I just want to know where is my "H1B Visa Extension Application" needs to apply by my employer.
Following are the details,
1. My Employer located in Virginia.
2. My current work location is Minnesota (and applying the H1extension with this Client's letter).
3. This is my second extension; i.e First H1b is for 2 years; and second H1b(i.e extension) for 3 years . all(5years) with the same employer.
4. I have approved I-140 also.
So 1) which will be the Service Center of mine to apply my H1B Extension
2) I heard Approved I-140 will be an advantage for a 3 year H1 extension application, but do this really matter if I have 3 months Purchase order or Contract with the client.
Please let me know.

My ead card production ordered. I efiled on April 27th.
Rediculous, the processing times say it takes 90 days minimum. Hopefully they will give the extension from my expiry date which is Aug 28th 2008.
As USCIS is saying they will issue 2 year ead starting Jun 30. certainly I will not get a 2 year EAD.

Keep an eye on the military appropriations bill Congress is working on for a potential immigration piece. The AP reports that Republicans want some serious money and personnel commitments for the southern border. And my own sources are telling me that some Democrats are looking at trying to get the DREAM Act in that same piece of legislation. Remember, DREAM allows for some who join the military to pursue permanent residency so it would be a germane part of the bill. A down payment on comprehensive immigration reform? Or the end of that effort and the return to piecemeal legislating?...

One of the comments on my post earlier today about the killed Border Patrol agent seemed pretty harsh - accusing most BP agents of being restrictionists with bad motives. I still think that's harsh and most Border Patrol agents are honestly out to do the necessary job of protecting our country's borders. As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.
